These Terms of Service (“Terms”) govern your use of our website and services (collectively, the “Services”) provided by SOULBROTHERS SRL. By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services.   —  

1. General

  1.1 Subscription-Based Service   Rubbing Mint operates as a subscription-based service. We do not enforce any long-term contracts or impose cancellation fees. You are free to cancel your subscription plan at any time.   1.2 Cancellation Policy   Subscription plans can be canceled at any point without any penalties or additional fees.   —  

2. Payment

  2.1 Setup/Onboarding Fees   If applicable, a setup or onboarding fee will be invoiced prior to the start of any services. Payment can be made via debit/credit card or bank transfer. Please note that all fees are non-refundable.   2.2 Subscription Payments   Payments for our subscription plans are made via direct debit. All subscription fees are non-refundable.   2.3 Payment Schedule   – Without Setup Fee: If your plan does not include a setup fee, the first direct debit payment will be collected when we commence work on your project. Payments will continue until you cancel your subscription. – With Setup Fee: If a setup fee is applicable, the first direct debit payment will be taken once your project is built and awaiting your content. Payments will continue until you cancel your subscription.   2.4 Additional Services   Any additional work outside of your subscription plan will be charged separately. All costs will be agreed upon by both parties before any work begins and are payable via bank transfer, card payment, or other agreed methods.   2.5 Late or Missed Payments   Late or missed payments may result in temporary suspension of your services. This is an automated process that occurs when your account is more than three days overdue. Services will be reinstated once your account is settled.   2.6 Service Cancellation Due to Non-Payment   If payments are overdue by more than 14 days, all your services may be canceled. This includes website hosting, email services, SSL certificates, domain names, marketing, and SEO services.   2.7 Interest on Overdue Payments   Failure to pay after 30 days may result in interest charges on the outstanding amount, calculated according to the applicable laws and regulations.   —  

3. Services Provided by Rubbing Mint

  3.1 Design Process   Our goal is to provide modern, responsive, and content-managed solutions quickly and cost-effectively. We achieve this by following a strict design and build process, which requires timely and organized input from you.   3.2 Design and Build Workflow   Our streamlined process eliminates preliminary stages like wireframing and prototyping to reduce costs:  

1. Briefing: We collect a comprehensive brief from you.
2. Initial Build: We create your project’s homepage and provide a live link for your review.
3. Collaboration: We work collaboratively to refine the homepage until you approve.
4. Completion: We build the rest of your project using the approved design elements.
5. Launch: Once you are satisfied with the final product, we make it live.

  3.3 Use of Stock Materials   During the design process, we may use stock images, videos, graphics, or icons for initial designs and presentations. These can be replaced with your specified content when available.   3.4 Custom Development   Our subscription plans do not include custom development or functionality beyond the specified features. We can provide a separate quote for additional custom work if required.   3.5 Exclusions   The following are not included in our standard subscription plans:   – Custom animations created by us. – Custom video content created by us.   3.6 Communication Methods   To keep costs low, all project communications are conducted via online tools like video conferencing and project management platforms.   3.7 Design Brief   The quality of the final design depends on the detailed brief you provide. We encourage you to use our online briefing form to give us as much information as possible.   3.8 Design Revisions   While we welcome feedback and amendments, our streamlined process does not allow for complete redesigns. We stress the importance of providing a detailed brief to meet your expectations.   3.9 Post-Launch Changes   Any design changes, upgrades, or additional functionality requested after the project is finalized can be accommodated by upgrading your subscription plan or through a separate quote.   3.10 Monthly Updates   Your subscription plan includes a specified amount of time each month for updates and changes to your project. This time cannot be carried over to subsequent months.   3.11 Access Restrictions   For security reasons, we do not provide top-level administrator access to our systems.   —  

4. Ownership and Intellectual Property

  4.1 Service Ownership   You do not own the Rubbing Mint website or the projects outright. All projects are hosted on our servers and are non-transferable.   4.2 SSL Certificates   SSL certificates are provided by SOULBROTHERS SRL and are non-transferable. Inclusive SSL certificates are only applicable if the domain name is hosted with us.   4.3 Domain Names and Email Services   You retain ownership of any domain names and email services included with your subscription. You may transfer these away from us at any time without additional cost.   —  

5. Invalidity

  If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.   —  

6. Liability

  6.1 Limitation of Liability   Except for cases of death or personal injury caused by our negligence, we are only liable for losses that are a foreseeable consequence of our breach of these Terms.   6.2 Your Responsibility   You are responsible for all claims, liabilities, damages, costs, and expenses incurred as a result of your breach of these Terms.   6.3 Loss or Damage   In the event we lose or damage your goods, we will cover the reasonable costs of repair or replacement, less depreciation.   6.4 No Limitation on Certain Liabilities   Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence.   —  

7. Governing Law and Jurisdiction

  These Terms are governed by the laws of Romania, European Union, and any disputes will be subject to the exclusive jurisdiction of the courts located there.   —  

8. Entire Agreement

  These Terms constitute the entire agreement between you and SOULBROTHERS SRL regarding the Services and supersede any prior agreements or understandings.   —
